Contractual Information:
All orders are subject to acceptance by us. After placing an order, you will receive an email from us acknowledging that we have received your order. This does not mean that your order has been accepted, only that you have made an offer to us to buy the product(s). Acceptance of your order will be confirmed by us only when we send you a Shipping Confirmation email.
The Contract will relate only to those products whose dispatch we have confirmed in the Shipping Confirmation. We will not be obliged to supply any other products which may have been part of your order until the dispatch of such products has been confirmed in a separate Shipping Confirmation.
In some instances we might use a third party to supply products, in which case we do not own or stock those products ourselves. We may also provide links on our site to the websites of other companies, whether affiliated with us or not. We cannot give any undertaking that products you purchase from third party sellers through our site, or from companies to whose website we have provided a link on our site, will be of satisfactory quality, and any such warranties are disclaimed by us absolutely. This does not affect your statutory rights against the third party seller. We will notify you when a third party is involved in a transaction, and we may disclose your customer information related to that transaction to the third party seller.
No contract for the sale of any product will exist between you and Sail Electronics until Sail Electronics or the third party has dispatched the goods. Payment for products may be taken from your account prior to dispatch, but will not be transferred to our acount until after the item is dispatched.
The Distance Selling Regulations give you the right to change your mind and cancel an order within seven working days after the day on which the goods are received. If you decide to cancel, then you should put this in writing, either by letter or email.
Although we endeavour to ensure that all pricing information on the Website is accurate, occasionally an error may occur. If we discover a pricing error we will, at our discretion, either: contact you and ask you whether you wish to cancel your order or continue with the order at the correct price; or notify you that we have cancelled your order. We will not be obliged to supply goods at the incorrect price.
Cancelling:
If you are contracting as a consumer, you may cancel a contract at any time within seven working days, beginning on the day after you received the products. In this case, you will receive a full refund of the price paid for the products in accordance with our refunds policy.
To cancel a contract, you must inform us in writing, either by letter or email. You must also return the product(s) to us as soon as is possible, to the returns address we give you and in the same condition in which you received them, and at your own cost and risk. You have a legal obligation to take reasonable care of the products while they are in your possession. If you fail to comply with this obligation, we may have a right of action against you for compensation. Details of this statutory right, and an explanation of how to exercise it, are provided in the Shipping Confirmation. This provision does not affect your statutory rights.
Delivery Information:
Your order will usually be dispatched within 1-3 days of the acceptance of your order or in some cases by the date specified in the Shipping Confirmation or, if no delivery date is specified, then within 30 days of the date of the Shipping Confirmation, unless there are exceptional circumstances, in which case you will be notified, and given the opportunity to cancel. We normally aim to despatch your order within 2 working days of receipt of payment. Any changes to this schedule will be advised at the time off ordering.
The products will be at your risk from the time of delivery and ownership of the products will only pass to you when we receive full payment of all sums due in respect of the products, including delivery charges.You will be responsible for the goods from the time you accept delivery.
Back Orders:
If your item is not in stock, we will back order for you. You will always be emailed or contacted by phone with the option to cancel your order if you would rather not wait.
Description & Pricing:
The price of any products will be as quoted on our site, however, in cases of obvious error, we are under no obligation to provide the product(s), and we reserve the right to supply any product which is wrongly priced, at our discretion. Our site contains a large number of products and despite our best efforts, some of the products listed on our site may be incorrectly priced.
We will normally verify prices prior to dispatch, and in instances where the product's correct price is less than our stated price, you will usually be charged the lower amount. If a Product's correct price is higher than the price stated on our site, we will, at our discretion, either contact you before dispatching the product, or reject your order and notify you of such rejection. We are under no obligation to provide the product to you at the incorrect (lower) price, even after we have sent you a Dispatch Confirmation
We will take all reasonable care to ensure that all details, descriptions, photos and prices of products appearing on the website are correct at the time when the relevant information was entered. Although we do our best to ensure that the website is as up to date as possible, the information, including product descriptions and product images appearing on the website at a particular time may not always reflect the product description exactly. Always refer to the product description carefully. If you have any doubt regarding the suitability of a product, please contact us before placing an order. If you become aware of any error with the description images or pricing of a product we would be grateful if you could notify us by email of the error.
The prices include VAT at the current rate but exclude delivery costs, which will be added to the total amount as set out in our Shipping Information displayed in these terms and conditions. VAT registered companies within the EU but outside the UK should contact us before placing an order. Delivery of overseas orders will be charged at cost .Please e-mail us or give us a call and we will quote you before your order is processed. Delivery to some areas inside the UK may be subject to a shipping surcharge, and in thes instances, we will inform you before your order is processed. Delivery surcharges may also apply to some products - (exceptionally heavy or long) and we will inform you if this is applicable, prior to dispatch.
If you order Products from our site for delivery outside the EU, they may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please contact your local customs office for further information before placing your order. Please note that you must comply with all applicable laws and regulations of the country for which the products are destined. We will not be liable for any breach by you of any such laws.
Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a Shipping Confirmation. All prices include VAT at the current UK rate. For non UK customers other rates may apply. Please contact us for details.
Payment:
We accept major credit cards and PayPal. We do not charge for any item until it is ready to ship. Back ordered items are not charged until they are shipped. We regret we cannot accept multiple credit cards as part payment for a given order. We reserve the right to request a payment by BACS/IBAN for any order of a significant value. We reserve the right to request a 20% non-refundable deposit on special orders made up wholly or in part of items not displayed on our website or not usually stocked by us.
We use HSBC Secure ePayments who provide a safe and effective shopping system. HSBC will under take the card transaction on our behalf. Your personal card details are securely held by HSBC and they never divulge your card details to us.
Guarantee:
We guarantee your satisfaction. All of our products are brand new, unless otherwise stated, come with a minimum of 1 years warranty, and are sourced in the U.K. No grey imports.
Privacy Policy:
Sail Electronics does not disclose buyer's information to third parties. Cookies are used on this shopping site, but only to keep track of the contents of your shopping cart once you have selected an item.
Returns & Refunds:
You are entitled to cancel your contract if you wish providing you do so within 7 working days of receipt of the goods. If you wish to exercise this right prior to dispatch of goods please email us at admin@sailelectronics.co.uk. If your order has already been dispatched please refer to our returns information. Please note that your right to return products does not apply to certain software and cartography products, and you will be notified of any exceptions prior to dispatch.Goods that have been specially ordered by Sail Electronics will be returned to the relevant supplier and all charges from our supplier including carriage costs will be passed on to the customer.
You are responsible for any returned goods until they reach us. We recommend that you obtain a Proof of Postage certificate which are available free of charge from the Post Office. Postage packing and insurance costs are not refundable except where cancellations and returns are in accordance with the Distance Selling Act.
Goods that have been supplied in error by Sail Electronics will be credited in full including all carriage costs. Goods returned for credit as not required for any reason may be subject to a restocking / administration charge of 15% of the retail price of the goods. We will not refund any carriage costs, unless the item was faulty or supplied in error by us. All items returned for credit must be unused and in their original packaging. Any items not meeting these requirements may be refused.
We will always endeavour to answer any query or resolve any problem you may have when ordering from us. Before returning any goods, for whatever reason, please contact us first. We will do our best to sort it out or supply you with a RMA . If an item has been supplied incorrectly, or is damaged, please contact us for an RMA and to discuss the best means of return. Please do not return goods to us without this or they may be refused.
If you want to return an item for any other reason, you may do so within 7 days of receipt. We shall refund the cost of the goods, providing the goods are in perfect resaleable condition. We do not reimburse postage costs in this instance. In all cases, returns authorisation (RMA) MUST be granted by us prior to returning goods. We regret we are unable to arrange collection of items. We advise you to obtain a proof of postage certificate or use recorded delivery when returning goods.
Liability:
We warrant that any product purchased from us through our site is of satisfactory quality and reasonably fit for all the purposes for which products of the kind are commonly supplied. Our liability for losses you suffer as a result of us breaking this agreement is strictly limited to the purchase price of the product you purchased [and any losses which are a foreseeable consequence of us breaking the agreement. Losses are foreseeable where they could be contemplated by you and us at the time your order is accepted by us]. This does not include or limit in any way our liability for death or personal injury caused by our negligence; Under section 2(3) of the Consumer Protection Act 1987; For fraud or fraudulent misrepresentation; or for any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.
We are not responsible for indirect losses which happen as a side effect of the main loss or damage and which are not foreseeable by you and us (such as loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data, waste of management or office time) however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.
Applicable laws require that some of the information or communications we send to you should be in writing. When using our site, you accept that communication with us will be mainly electronic. We will contact you by email or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.
We reserve the right to revise and amend these terms and conditions from time to time. You will be subject to the policies and terms and conditions in force at the time that you order products from us, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to those policies or these terms and conditions before we send you the Dispatch Confirmation (in which case we have the right to assume that you have accepted the change to the terms and conditions, unless you notify us to the contrary within seven working days of receipt by you of the Products).
